I'll take my error over your inability to be logically consistent any day.
There's a HUGE difference between an actual crime motivated by hate vs. words being spoken to someone. A "hate crime" would be a crime whether it's motivated by race or something totally different. For example:
1. In Crime A, someone shoots someone in order to steal their phone. The crime is motivated by money/personal gain. The victim dies.
2. In Crime B, someone shoots someone else just because they hate that person's race. The crime is motivated by hate and can therefore be classified as a "hate crime." Just like in Crime A, the victim dies.
The end result is the same. The only thing that's different are the motivations of the criminal. Whether the criminal is racist or not has no bearing as to the seriousness of the crime. The victim is killed in both instances.
I can go up to a black person and call them the N word and say that their mother is a smelly whatever. That's not a "hate crime." That's me being an asshole. If the person I was being an asshole to decided to beat me up, they would have committed an actual crime (assault). I would be guilty of being an asshole but you can't lock someone up for being an asshole.
On the other hand if I was posting on social media a plan to go shoot up a black church, that is NOT free speech, that's a threat and should be taken seriously be the authorities. I should be arrested/interrogated and probably assessed by a mental health professional.
The purpose of the law is to keep order and protect people. It is not the police's job to protect you from hurt feelings or from being offended. As a society we shun people who are being assholes and assholes very quickly learn not to be that way unless they have some sort of mental problem.
